Agreement

These terms govern your use of the Promptish website (promptish.io) and any services provided by Promptish ("we," "us," "our"). By using our website or engaging our services, you agree to these terms.

If you're entering into a service agreement with us, a separate project scope and quote will define the specific deliverables, timeline, and price. These terms cover the general rules that apply to all engagements.

Services We Provide

Promptish is a technology consulting and automation agency. Our services include:

• Workflow automation design and implementation
• Website development
• Brand strategy and positioning
• Technology stack optimization
• Managed operations and ongoing support

The specific scope, deliverables, and timeline for each project are defined in a written project proposal that both parties agree to before work begins.

Pricing and Payment

We use a flat-rate pricing model. Before any work begins, you receive a fixed quote for the defined scope. There are no hourly rates, no surprise invoices, and no scope creep charges.

Payment terms are outlined in each project proposal. Typical structure:

• A deposit to begin work (usually 50%)
• Remaining balance upon delivery

If the scope changes after approval, we'll provide an updated quote for your approval before doing any additional work.

Code and Deliverable Ownership

Upon full payment, you own all deliverables we create for your project. This includes:

• All custom code, scripts, and automation workflows
• Documentation and training materials
• Design assets created specifically for your project
• Configuration files and deployment instructions

We retain no proprietary claim to your deliverables. If we disappear tomorrow, your systems keep running and you have everything you need to maintain or modify them.

We reserve the right to use general knowledge, techniques, and non-client-specific methodologies gained during the project in our future work. We will never share, publish, or reuse your proprietary business data or custom implementations without your written consent.

Your Responsibilities

For us to do our job effectively, you agree to:

• Provide timely access to the systems, accounts, and information needed for the project
• Respond to questions and review requests within a reasonable timeframe
• Ensure that any information you provide is accurate and that you have the rights to share it
• Make payments according to the agreed schedule

Delays caused by late access or unresponsive communication may extend the project timeline.

Limitation of Liability

We build and test carefully, but automation operates within real-world systems that can change without notice. To the maximum extent permitted by applicable law:

• Our total liability for any claim arising from our services is limited to the amount you paid us for the project in question.
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.
• We are not responsible for downtime, changes, or failures in third-party services (Google, Microsoft, etc.) that your automations depend on.

We deliver functional, tested systems and stand behind our work. But we cannot guarantee that external platforms won't change their APIs, terms, or availability.

Termination

Either party can terminate a project engagement with written notice. If you terminate before completion:

• You owe payment for work completed up to the termination date
• You receive all deliverables completed to that point
• Deposits for uncompleted work are non-refundable if we have already begun the work

We reserve the right to terminate if payment obligations are not met or if the project becomes untenable due to circumstances outside our control.

Website Use

You may use the Promptish website for its intended purpose: learning about our services and contacting us. Don't use it for anything illegal, abusive, or designed to interfere with its operation. Content on this site is our intellectual property unless otherwise noted.

Changes to These Terms

We may update these terms from time to time. Material changes will be reflected on this page with an updated effective date. Existing project agreements are governed by the terms in effect at the time the project was scoped.
